Who this agreement is between
These Terms of Use form a binding agreement between you (the player) and Olivia Griffin (the "Publisher", "we", "us"), the developer and publisher of the mobile game Teoiko Hex.
They cover the game software, its puzzle content, artwork, sound, and any updates or additional levels we release for it, unless a specific release is accompanied by its own separate terms.
Your licence to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play one copy of Teoiko Hex on devices you own or control, for your own private, non-commercial entertainment.
This is a licence, not a sale. The game itself — its code, level designs, block and arrow mechanics, visual identity and the name "Teoiko Hex" — remains the property of the Publisher and its licensors, and all rights not expressly granted here are reserved.
What you agree not to do
You agree that you will not, and will not help anyone else to:
- copy, sell, rent, sublicense or otherwise distribute the game or its assets;
- reverse engineer, decompile or disassemble the game, except where that right cannot lawfully be excluded;
- modify, patch or create derivative versions of the game, or repackage it into another application;
- extract level data, artwork, audio or code for use in another product;
- remove or obscure any copyright, trademark or attribution notices;
- use automated tooling to solve, farm or otherwise interfere with the game in a way that disrupts its intended operation for others;
- use the game in any way that breaks the law where you are.
Solving a board in an unusually clever order is, to be clear, entirely permitted and rather the point.
Your progress and local data
Teoiko Hex saves your progress, board state and preferences in local storage on your device. We do not operate a cloud save service, and we cannot recover your progress if it is lost.
Progress may be lost if you uninstall the game, clear its app data, factory reset the device, move to a new device, or if your operating system removes app data during storage management. This is a consequence of the game's on-device-only design, and you accept it as a condition of play.
Updates, changes and availability
We may release updates that fix bugs, adjust puzzle difficulty, add or retire levels, or change how parts of the game look and behave. Some updates may be required for the game to keep working on newer operating system versions.
We may also, at our discretion, stop publishing or supporting the game. Copies already installed will generally keep working offline, but we do not guarantee continued availability, compatibility with future devices, or the presence of any particular feature or level.
Provided "as is"
To the fullest extent permitted by law, Teoiko Hex is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by applicable law, the Publisher will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, loss of progress, loss of profits or loss of goodwill, arising out of or connected with your use of or inability to use the game.
Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the greater of the amount you paid for the game in the twelve months before the claim, or the sum of €10. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you.
Payments, refunds and store transactions
Any paid download or in-app purchase associated with Teoiko Hex is processed by your app store, not by us. We do not receive or store your card or payment details.
Refunds are handled under the policy of the store where you bought the game, and refund requests should be made there. If a store grants a refund, the licence granted in Rule 2 ends for the refunded content.
Ending this agreement
You may end this agreement at any time by uninstalling the game and deleting all copies. We may suspend or end your licence if you materially breach these Terms, in particular Rule 3.
Sections that by their nature should survive termination — intellectual property, warranty disclaimers, limitation of liability and governing law — continue to apply after the agreement ends.
Governing law, changes and contact
These Terms are governed by the laws applicable at the Publisher's place of establishment, without regard to conflict-of-law rules, and without depriving you of the mandatory consumer protections available to you where you live.
We may revise these Terms; the current version always appears on this page with its effective date, and continued play after a revision means you accept the updated version. If any provision is found unenforceable, the rest remains in force. These Terms, together with the Privacy Policy, are the entire agreement between us about the game.
Questions about these Terms go to olivia.griffin82@gmail.com, or via the support page.
